1. Who we are

Namelix (namelix.ai) is operated by Escala Digital Solucoes LTDA ("Namelix", "we"). By using the service, you contract directly with Escala Digital Solucoes LTDA.

Namelix is an AI brand name generator with domain availability checks and a Duel Arena to help you decide.

2. Acceptance

By creating an account or continuing to use the service, you agree to these Terms & Conditions. If you do not agree, do not use the service.

You represent that you are of legal age to contract or have authority to bind the organization you represent.

3. Account and credentials

You are responsible for keeping your login credentials confidential and for all activity under your account. Provide accurate information and keep it up to date.

4. Acceptable use

You must not use the service for: unlawful purposes; fraud or spam; infringing third-party intellectual property; interfering with the service's security (including malware, unauthorized probing and automated scraping); reverse engineering; reselling or redistributing the service; or circumventing technical limits.

AI-generated content: you are responsible for the prompts you submit, how you use the generated names, verifying their suitability, and ensuring you have rights to the content you provide. Generated names may resemble existing trademarks — always run a trademark search (e.g. USPTO in the US, WIPO internationally) before registering or using commercially. If you are a rights holder and believe a generated name infringes your mark, contact us for review and takedown; repeated infringement may lead to account suspension.

We may moderate content, refuse or filter outputs, and suspend accounts that violate these rules.

5. Intellectual property

The service, including software, documentation and branding, is owned by Escala Digital Solucoes LTDA. We grant you a limited, non-exclusive, non-transferable right to use the service within your purchased plan.

Names generated for you may be used freely, but we do not guarantee exclusivity or registrability. AI outputs may be inaccurate and are not a substitute for professional legal advice.

6. Payments and credits

Packs are one-time payments (no subscription, no auto-renewal). Each generated name consumes 1 credit and credits never expire.

USD and EUR payments are processed by Stripe (card); BRL payments (Pix or card) are processed by Mercado Pago. Escala Digital Solucoes LTDA is the seller for all orders and handles support and refund requests at suporte@namelix.ai.

Credits are released as soon as the payment provider confirms the purchase. Refunds follow our Refund Policy.

7. Service level and warranties

The service is provided "as is". We do not guarantee uninterrupted or error-free performance. To the fullest extent permitted by law, we disclaim implied warranties of merchantability and fitness for a particular purpose.

8. Limitation of liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months preceding the event. We are not liable for indirect, consequential or special damages (loss of profits, data or goodwill). Nothing in these terms excludes liability for fraud, death or personal injury where required by law.

9. Suspension and termination

We may suspend or terminate your access for: material breach of these terms, non-payment, security or fraud risk, or repeated/serious policy violations. Upon termination, unused credits are forfeited and your data may be deleted after a reasonable period.

10. Governing law and contact

These terms are governed by the laws of Brazil. Disputes will be resolved in the courts of the jurisdiction of Escala Digital Solucoes LTDA's registered office, unless otherwise required by law.
